Contract B EXAM SCRIPT
Subject notes for Monash LAW2102
Description
My exam notes cover all topics in Contract B, and are written in a logical fashion. In writing it, my goal was to be able to easily follow the elements to establish each topic, and be able to easily insert facts to my template answers to be as time efficient as possible in writing my exam answers. These template answers include counter-arguments allowing you to answer the problem questions thoroughly. I relied on this script for the exam, supported by my topic summaries as back-up. TOPICS INCLUDE: Right to terminate: - Under contract agreement - For Breach - Of condition - Substantial breach of an intermediate term - For repudiation - Restrictions - Consequences Remedies: - Damages - Measure - Limitations - Specific Performance -Injunction - Action for debt - Liquidated damages or Penalty? - Restitution (with basis of unjust enrichment) - Frustration - Test - Consequences Vitiating Factors - Misleading and Deceptive Conduct - Duress - Undue Influence - Unconscionable Conduct - 3rd party impropriety - Statutory Unconscionable Dealing - Remedies Disclaimer: Whilst I did my best to collate these notes, making them as accurate as possible, I do not guarantee or claim that they are faultless!
