Description

These notes are all you need for the optional mid semester assessment and final examination - they are incredibly detailed, well-formatted and build upon the seminar content. All examinable topics are thoroughly covered; along with the introductory and background subjects discussed in class. The notes are directly applicable to Jeanne Huang's stream (the larger stream excepting Ross Anderson's classes); however, during the preparation of my notes I also reviewed notes from Ross Anderson's stream and the topics are largely the same (Ross' classes actually cover less material). Thus, my notes should be relevant to your study no matter which of the two streams you undertake. PLEASE NOTE: Generally, the syllabus for law units changes at the beginning of every year. As I completed LAWS2018 in Semester 1 of 2019, my notes should be in accordance with the UOS outline for the remainder of this year (this cannot be guaranteed with prior year notes). Topics include (per Semester 1 of 2019): 1. Introduction to Private International Law 2. Personal Jurisdiction: at common law; service in Australia; service in NZ 3. Discretionary non-exercise of jurisdiction: foreign jurisdiction clauses 4. Discretionary non-exercise of jurisdiction: forum non convenient; intra-Australian and NZ cases 5. Anti-suit injunctions 6. General Applicable Law Topics: introduction to choice of law in Australia; characterisation 7. Substance and procedure 8. Foreign law 9. The law applicable to torts 10. The law applicable to contracts 11. Mandatory rules and the laws of the forum 12. Recognition and enforcement of foreign judgments
