HD ADMIN LAW NOTES
Subject notes for Monash LAW4331
Description
Very concise notes, easy to navigate during the exam. Admin law is not content heavy and more conceptually difficult, and I have summarised and formatted it in a way that is visually pleasing (making a dry unit a little easier to bear with) and I was able to confidently use them to write HD answers in the exam. Every relevant case and statute is included. TOPIC LIST: Topic 1: Not examinable Topic 2: Jurisdiction (common law/statutory approach) Topic 3: Standing (AG's fiat, interests affected) Topic 4: Reasons for decisions (common law/statutory position) Topic 5A: Acting beyond power (admin action beyond scope, breach of essential procedural condition, decision maker not empowered ) Topic 5B: Abuse of power (relevant considerations, improper purpose/bad faith, unreasonable) Topic 5C: Fact finding errors (no evidence, jurisdictional fact) Topic 5D: Failure to exercise discretion (inflexible application of policy, acting under dictation) Topic 6: Procedural fairness (hearing rule, rule against bias) Topic 7: Jurisdictional error Topic 8: Remedies Topic 9: Privative clauses Topic 10: Merits review
