Topics covered include: Week 1: Introduction to Competition and Consumer Law, including the Competition and Consumer Act 2010 (Cth), Australian Consumer Law, key regulators, “consumer” and “in trade or commerce”. Week 2: General protections under the ACL, including misleading or deceptive conduct, silence, future representations, puffery, unconscionable conduct and unfair contract terms. Week 3: Specific ACL protections, including false or misleading representations, unfair practices, consumer guarantees, product safety, information standards and manufacturer liability. Week 4: Restrictive trade practices, including cartel conduct, price fixing, market allocation, bid rigging, s 45 arrangements and substantial lessening of competition. Week 5: Misuse of market power, exclusive dealing and resale price maintenance, including ss 46–48 of the Competition and Consumer Act. Week 6: Enforcement, penalties, remedies and defences, including ACCC powers, civil/criminal liability, injunctions, damages, pecuniary penalties and enforceable undertakings.
