Contracts Summary Table - DISTINCTION
Subject notes for UNSW LAWS1075
Description
This concise table helps you understand how the contract topics fit together with a high level overview of each, topic the rules and the approach for the topics (with case citations). When studying contracts in 2010, I realised it’s easy to get overwhelmed with all the cases and topics and not understand how they are relevant and how they fit together in order to answer a problem question. So I created this table which I can quickly refer to when answering a problem question to make sure I’ve identified all the issues and have structured the issues in a logical sequence. Topics covered include: - Identifying Express Terms - Extrinsic Evidence - Construing Terms - Implied Terms - Frustration - Termination - Repudiation - Restrictions on Termination - Damages (including liquidated damages and debt) - Remoteness - Mitigation - Actions for Debt Note: This table may need updating to account for new cases or other topics, but at least this will give you a fuller picture of how to approach and understand these topics.
